Look How Fast Libs Become 10th Amendment Advocates

The Army Corps of Engineers is planning to defy the state of Delaware and start dredging the River. The list of liberals who have all of a sudden discovered the 10th amendment and state’s rights is long. So is my enjoyment at watching them scramble. For the record, I hope they win. Whatever the merits of the dredging, Delaware has a right to its permitting process. Federal law confirms it.










Another attempt at a false equivalency:
Unpermitted dredging: Write a legal brief.
Social spending you don’t like: Write an “Obama=Hitler” sign.

The 10th Amendment seems to be an amendment of convenience for some. Funny, that.
Leftist judges and legislators, long ago, sanctioned the blatant disregard of the Constitution, i.e., Article I., Section 8., under the guise of the ‘General Welfare’ clause within. This, despite the clear intent of the language as expressed by Madison (the ‘father’ of the Constitution) in the last four paragraphs of Federalist #41. Hence, according to ‘liberal’ Constitutional interpretation, the Congress has the power to do virtually anything.
This is why the United States is hopelessly bankrupt, and on the verge of oligarchic dictatorship.
“States rights? What ‘states rights?’ We shall dredge the Delaware- for the ‘General Welfare’ of the people of the United States. Delaware, go to hell.”
Shirley – do you have a list of unaddressed Tenth Amendment violations, or do you just want to leave that hanging as a smear?
The sad part is dredging goes on all the time, yes all the time. The recent episode deals with deepening the channel which I support.
I look forward to those who oppose the dredging to deepen to also oppose all dredging.

If done correctly, I could support it, but there would have to be very stringent environmental safeguards. I would like a full and open hearing where we can decide. The merits aside, I believe in local input. They hope for an outcome. I am defending a process without regard to outcome.
I haven’t looked in to it, but why all the hysteria about dredging a polluted river? Perhaps they’ll find Jimmy Hoffa’s body, and Delaware can be famous for something other than producing an idiot.

How did the pollution get there, and why aren’t we holding the polluters responsible for the costs of the studies and any mitigations required for dredging?
It is like saying “No, don’t build anything on that spot, you might dig up Jimmy Hoffa’s body, and nobody wants to see that.”
