Litigation Specialist Suing Over Gender Discrmination at a Breast Cancer Awareness Event

Jun 11th, 2009 by RSmitty

I am not kidding. A male attorney makes a hundreds-of-miles trip to purposely put himself into a womens’-geared promotion for Breast Cancer Awareness and turns around and sues for gender discrmination. Apparently he’s close to a half-million+ dollar settlement. My wife was almost was killed in 2005 by a negligent *itch who passed people on a curve, over a double-yellow, and hit her head-on at over 50MPH. We were “awarded” 30k before 33% + fees + subrogation. We are almost now at over $60k in medical bills plus massive financial problem that resulted from it. The insurance company was allowed to argue that a child we had two years later was to blame for the on-going medical issues. FTR, my wife had zero complications around the birth of that child. Yeah, tort law is totally effing fair.

Here is the article on the litigation specialist. Prepare to puke.

    “Prepare to puke.” – RSmitty

Too late I already did before following your link. Thanks for trying to warn us though.

Anyone want to guess if SB 121, the Senate version of HB 5 will invite more discrimination lawsuits of this insane nature, or less? Reality is being warped here.

It is foolish to settle. Just ask for an immediate trial. If you don’t want to fight it, allow a default judgment before a judge and make him prove damages. He won’t get much more than the costs to get their and back. There is no way that he will win anything. This guy must need money and is shaking down a charity for it. Disgusting.

  3. on 12 Jun 2009 at 09:303RSmitty

David, in the article, Rick Reilly points out this is the history of this specialist. He really doesn’t need the money, unless he goes up to Vegas or Lake Tahoe with his “damages” every time. This specialist has successfully sued to end “Ladies Night” promotions in many places, which in itself is pathetic, opportunistic bottom-feeding. Maybe he has an immense inferiority complex, who knows? Anyways, he has a history based on an awful loophole in a CA law that had right intentions in the 50′s, but he’s manipulated to death for his own gain.

If you haven’t read the linked article, go and do so for perspective. Bring a puke bucket with you, though.

A lot of people who had money and love the lifestyle are secretly hurting right now. Just because you are rich, doesn’t mean that you know how to stay rich. Many people who made money wasted it, then when the markets tanked they had no back up. I bet he is underwater in a couple of his homes and his Jag has bald tires.

  5. on 12 Jun 2009 at 09:405RSmitty

It’s not his tires that are bald, it’s his morality.

  6. on 12 Jun 2009 at 09:446David Anderson

People like him give a bad name to lawyers. He is also undermining the right to sue by people who have real damages.

The most disgusting part is that his own mother died of breast cancer in her 50′s, but he can’t let a promotion go forward because he didn’t get his floppy sun hat. I say give him a hat and tell him go fishing. He has no real damages. His class action should be rejected because not one person has joined.

  7. on 12 Jun 2009 at 09:457David Anderson

What morality? I question if he even has a conscience.

  8. on 12 Jun 2009 at 10:218RSmitty

It’s not that he didn’t even get his plastic pink sun visor. He made a road trip from SD to Oakland (LOOONNNGGG trip) to attend this very specific game with this very specific promotion…a person who has a litigation history of suing female-centric events for gender discrmination.

  9. on 12 Jun 2009 at 10:439David Anderson

I know. The man is scum. They need to change the CA law. They have known for years that this is an issue.

He made an eight to 10 hour road trip (want to bet he flew) not to see the game but to set them up. My point is that his legal damages are only what he was out of. I have to question the judgment of the judge who is entertaining this as a serious class action lawsuit when no one else will join. That is why I always tell people don’t argue. Just give them the item.

It seems like you have evil attorney and stupid judge to make a crazy combination.
