Saga of “Millie” Continues

by: Wolf von Baumgart, Staff Writer The Dog Panel hearing in the Jake and Nancy Smith case, involving their pet, "Millie" is scheduled for 7 p.m., Monday, April 13 in the Sussex County Council Chambers, located on 2 The Circle in Georgetown, DE according to a 4/7/15 article in the Cape Gazette. "Millie", a white and brown Jack Russell Terrier mix, alleged to be a dangerous animal by a few of Smith's neighbors, is reportedly being held incommunicado at the First State Animal Shelter, located on 32 Shelter Circle, Camden, DE 19934. We are unable to confirm this due to a judicial gag order, issued in this case. The panel is charged with determining the dog's ultimate fate, up to and including possible euthanasia. Read more

** UPDATE ** Smith v. SPCA

By: Wolf von Baumgart, Staff Writer A judicial gag order has been issued on all parties concerned in the case of litigation of John "Jake" and Nancy Smith (plaintiffs) against Delaware Animal Care and Control, filed in Delaware Superior Court over possible illegal impoundment of their dog, "Millie" under guise of authority. Attorney John Brady, representing the Smiths contends that the 1981 state statute that excluded Sheriffs and Sheriff's Deputies from certification as police offices by the Delaware Council on Police Training also did not include animal control officers as police officers. The litigation essentially argues that only sworn and certified police officers can legally execute arrest and search and seizure warrants under the present Delaware Code, Title 11, Chapter 19. Both Kent and Sussex Counties have contracted animal control services with the First State Animal Read more

The FCC Diversity Officier admires this Guy

Another 29 Radio stations are shut down by Chavez and the one opposition television network is under threat. This is the guy that President Obama's FCC Diversity officer Mark Lloyd admires. If his new rules ever get adopted by the new Democrat majority at the FCC, it could be a foreshadowing of our future. He declared, "But he came back with another revolution, and then Chavez began to take very seriously the media in his country". Pat Caddell is right they are trying to flood the zone, but we have to be up to the challenge. Infrastructure Minister Diosdado Cabello closed 34 radio stations in July, saying the government was "democratizing" media ownership. Critics say the move limits freedom of expression and has taken critical voices off the airwaves. The powerful Chavez ally has threatened to close over 100 stations in total, part of a long-term campaign against private media Read more

Dark Clouds

There are dark clouds on the horizon if you are concerned about freedom of expression. We all know about the now defunct We have also heard about desires by some to reinstate the so called fairness doctrine in order to force out some of the loyal opposition and put them in limited air times. These efforts have not gained a great deal of traction. There are others which stand a much better chance of passage because they look more innocuous. Senator Jay Rockefeller -(D)ictator WV is pushing legislation which would give the President broad emergency powers over key parts of the internet. While it would make sense to allow the government to keep it up during an emergency (what company would not voluntarily agree to that) this bill would allow the take over of it. All of the major companies have raised objections to it and so have civil libertarians. The bill stalled Read more

Today’s WDEL Talkback: Legalize Sexting?

I called in response to this question, but the window of opportunity is incredibly small, relative to the time it demands.  It's based on the State of Vermont considering "legalizing" the practice of sexting.  What is sexting?  As WDEL describes it, it is basically the practice of sending sexually-suggestive, or even pornographic images of one's self to another person, very typically that person's dating-partner.  OK, married/civil partner, too, but really, how long have you been married?  Back to point, the motivation of the basis of this question is the black-and-white application of the Child Predator law.  You either did it, or you didn't, period.  There is no consideration of consent.  Yeah, consent.  16-year-old to another 16-year-old really is an entirely different set of psychological circumstances than that of, say, a 30-year-old interacting with a 16-year-old.  I may Read more

My Response to Not the GOP Anymore

There is controversy across America sparked by the amazing speech given at the Conservative PAC conference by famed talk show host Rush Limbaugh (and my mother‘s favorite talk show host). I regret deleting it from my DVR. I have watched the hour recap twice. I found it inspiring and instructive. It was a wake up call to Americans who care about freedom, the right to life, limited government, and unlimited human potential. We are losing our nation to the far left. I have yet to hear any substantive attacks on the speech. Even on this page we have become absorbed with Rush the personality. It would be like attacking Common Sense by attacking Paine. It misses the important event. One contributor is even considering leaving the party because Chairman Steele apologized to Rush for giving the impression that Rush’s show is ugly and incendiary. What I should be reading is a call to Democrats Read more

Not The GOP Anymore

First...thanks to Dave for bringing us back to the domain.  I am no longer blocked!  That said, this may be short-lived...maybe.  Depends how this post is taken. I twitted (sounds so wrong) via text this morning: Has my GOP lost its identity and become Buckley's (once) defunct Conservative Party?  Rush thinks it's so.  Limbaugh, you do NOT speak for me! What in the hell happened to the Republican Party?  What in the hell happened to the more moderate of us that brought the balance and tempered the extremism that makes us the isolationists that we are becoming? I am sorry, but I can't argue against DelawareLiberal's sentiment that our very own crowned-moderate has been acting somewhat of a sheep of Boehner.  Moderates are either scared or have been assimilated into the Borg machine. Congratulations, CPAC, you have finally done it in 2009.  You have Read more

Williams hearts Clark???

Does anyone else get the impression that wRonG Williams has this virtual love affair with the pro-development contingent of New Castle County executives, past and present?  (Note I specified pro-development...Chris Coons hasn't shown himself to necessarily be pro-development and there is no love loss between Williams and Coons) Want to see some bizarre logic at play that only seems to add to this mating ritual?  In order, review the links (all titles/headlines are that of the source linked) of The News Journal's online version, delaware online, of (1) the County Council's measure to get Clark to recuse himself, (2) wRonG Williams sending his affection, (3) WDEL's Allan Loudell chastising wRonG Williams, and for good measure, (4) Al Mascitti's Blog.  I threw Al in there simply because he has long exposed wRonG's virtual love affair with the pro-development contingent of New Castle County Read more
